Event terms and conditions:

These Event Terms (Terms) govern your purchase of tickets for, and attendance at events held by Seekers Festival (Events). It is your responsibility to review these Terms prior to the purchase of tickets. By purchasing tickets you agree to be bound by these Terms. We reserve the right to amend these Terms at any time, and will provide the most recent version on our website.

Throughout these Terms, the terms “Seekers Festival”, “we”, “us” and “our” refer to Business Chicks Australia Pty Ltd and its associated entities, and “you” refers to the individual or business purchasing tickets or attending Events.

  1. Event Booking and Ticket Purchase

1.1. A list of upcoming Events, and ticket and table prices are available on our website.
1.2. Business Chicks Premium Members may access discounted ticket and table prices as specified on our website. Proof of membership may be required.
1.3. In addition to the ticket or table price, you must pay GST and any booking, handling, credit card surcharge or postage fees specified on our website.
1.4. Ticket prices are subject to change, and Business Chicks will use best endeavours to inform you if there is a change.
1.5. You may make a booking and/or purchase a ticket for an Event:
1.5.1. online via our website; or
1.5.2. by submitting a request for a manual invoice to events@businesschicks.com.au with the name of the Event, location, number of tickets or tables and requested invoicing details.
1.6. If you choose to book via our manual invoicing process:
1.6.1. an administration fee of $49 is payable;
1.6.2. your request is subject to approval by Business Chicks;
1.6.3. full payment must be received at least 24 hours prior to the Event. If full payment is not received by this time, the booking will be cancelled with no notice to you;
1.7. Your booking is confirmed when you receive an email notification and receipt from Business Chicks. We will maintain a list of confirmed and paid up attendees for each Event, and you may gain entrance to the Event by presenting identification or your email receipt. You will not receive a hard copy or electronic ticket.

  1. Refunds, Credits and Transfers

2.1. All ticket sales and table bookings are final. No exchange, credit or refund will be given except in the case of certain cancelled or rescheduled Events (see clause 3 below). For clarification, you are not entitled to a refund if:
2.1.1. you did not enjoy the event;
2.1.2. you are no longer able to attend the event; or
2.1.3. you arrive late or are refused entry for any reason.
2.2. A ticket or table booking is transferrable to another person on the following conditions:
2.2.1. a request is submitted in writing to events@businesschicks.com.au containing the replacement guest name, business name and email address.
2.2.2. the request is submitted at least 48 hours prior to the event.
Business Chicks reserves the right to refuse entry if a replacement guest arrives at the event without the ticket being transferred via this procedure.

 

 

 

  1. Event Cancellation or Postponement

3.1. Sometimes Events are cancelled, varied, rescheduled or postponed due to Force Majeure Events, situations which affect the speaker or other causes.

3.2 If an Event is postponed:
3.2.1 you may, at your option exercisable by notifying us in writing no later than 30 days after the originally scheduled date of the postponed Event, obtain a credit for the ticket price to put towards another of our Events that occurs within 12 months of the originally scheduled date of the postponed Event; or
3.2.2 if you so elect, or if you fail to notify us in writing of your request for a credit within 30 days after the originally scheduled date of the postponed Event, your ticket will be automatically transferred to the new date for the postponed Event.
3.3. If an Event is cancelled and/or a new date for the Event is not announced within 60 days of the postponement/cancellation:
3.3.1  in circumstances where the Event is cancelled due to a Force Majeure Event, you will be given a credit for the ticket price to put towards another of our Events that occurs within 12 months of the originally scheduled date of the cancelled Event (no refunds will be issued);
3.3.2 in circumstances where the Event is cancelled for any reason other than a Force Majeure Event, you may, at your option exercisable by notifying us in writing no later than 30 days after the originally scheduled date of the cancelled Event, obtain a refund of the ticket price (excluding booking, credit card and other fees).  If you so elect, or if you fail to notify us in writing of your request for a refund within 30 days after the originally scheduled date of the cancelled Event, you will be given a credit for the ticket price to put towards another of our Events that occurs within 12 months of the originally scheduled date of the cancelled Event.
3.3. We will use reasonable endeavours to notify ticket holders of a cancellation, variation, rescheduling or postponement of an Event by sending an email to the address provided to us by the ticket holder and putting a notice on our website; however the responsibility to ascertain whether an Event has been cancelled, varied, rescheduled or postponed is yours. We do not guarantee that ticket holders will be informed of a cancellation, variation, rescheduled or postponement before the date of the Event.
3.4 Except as expressly provided in this clause 3, in no circumstances will ticket prices (or any part thereof) be refunded or credited.  Any refund or credit issued will be your sole remedy for a postponement or cancellation of an Event, and we will have no further liability to you in respect of any cancellation, variation, rescheduling or postponement of an Event for any reason.  Any credits issued for postponed or cancelled Events that are not used within 12 months of the originally scheduled date of the postponed/cancelled Event will be forfeited.

4. Event Conduct

4.1. You are expected to behave in a professional and appropriate manner at all Events. We reserve the right to refuse entry or require you to leave if your behaviour is deemed unacceptable.
4.2. You acknowledge that cameras, audio and video recorders may not be permitted at certain events. Business Chicks will advise whether this is the case at each event.
4.3. Business Chicks films and photographs every event. You consent to being filmed or photographed by Business Chicks (or its representatives) and to Business Chicks using your name, likeness, image and/or voice in such photographs or films for the purpose of promoting our events, services and products. No remuneration is payable for such use.

  1. Limitation of Liability

5.1. To the extent permitted by law, we exclude all conditions and warranties relating to your purchase of tickets for and attendance at Events.
5.2. Where our liability cannot be excluded, such as in relation to Consumer Guarantees under the Australian Consumer Law or other prescribed terms under legislation, our liability for breach is limited to the face value of the ticket purchased by you, plus any relevant booking and delivery fees.

5.3  We will be excused from performance under these Terms and in relation to Events to the extent such performance is affected by a Force Majeure Event.

  1. Miscellaneous

    6.1. These Terms shall in respects be governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts in New South Wales to determine any matter or dispute which arises under these Terms.
    6.2. If any provision of these Terms is deemed invalid or unenforceable, all or part of that provision will be severed from the Terms and will not affect the enforceability of the remaining provisions of the Terms.
    6.3. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. Any failure to assert any right under the Terms shall not constitute a waiver of such right.
    6.4 In these Terms, a “Force Majeure Event” means any of the following (whether or not foreseeable or anticipated): acts of God, terrorism, war, civil unrest, strike or labour dispute, lack of transportation, breakdown, labour or material shortage, blockade or embargo, supplier failure, epidemic or pandemic, government restriction or recommendation, legal requirement, extreme weather, earthquake, drought, fire, flood, explosion, natural disaster, and/or any other event, cause or circumstance that is beyond our reasonable control.
    6.5. These Terms constitute the entire agreement between Business Chicks and you in relation to the Events.

Movers and Breakers terms and conditions:

In these Terms of Sale, the following terms have the following meaning: Additional charges include all delivery, handling and storage charges; goods and services tax; stamp duty; interest; legal and other costs of recovery of unpaid money, and all other government imposts; and all money, other than the purchase price, payable by the customer to Business Chicks arising out of the sale of the goods or the provision of the services. Business Chicks means Business Chicks Pty Ltd ACN 121 566 934. Customer means the customer who purchases tickets for a Business Chicks event or who purchases goods or services. Ticket price means the price of ticket for the Business Chicks Movers and Breakers conference. Purchase price means the list price for the goods as charged by Business Chicks at the date of delivery, or such other price as may be agreed by Business Chicks and the customer prior to delivery of the goods. Services means those services sold by Business Chicks to the customer, including tickets to events. Cancellation date means the date upon which a cancellation of ticket has occurred, subject to the timeframe it has been cancelled prior to the event. Scroll down for cancellation-date terms. GST means Goods and Services Tax. As a part of our quality procedures, it is important that Business Chicks and the customer agree on the terms on which business is to be transacted. These Terms of Sale are current for trading with Business Chicks at the time of issue, however the Terms of Sale may vary from time to time. SERVICES All bookings for an event run by Business Chicks must be in writing. A booking is accepted by Business Chicks once written notification is provided to you. An acceptance of a booking by Business Chicks is then to be an acceptance by Business Chicks and the customer of these Terms of Sale, to the exclusion of any terms and conditions imposed by the customer. No booking is binding on Business Chicks until it is accepted. Entry to any event may be refused if the customer has not paid for the event in full in advance.

CANCELLATION POLICY

The customer may transfer their ticket to another person up until the 23rd September 2020, when notified in writing to info@moversandbreakers.com with the guest’s name and full registration details. Any booking cancellation must be in writing (email to info@moversandbreakers.com) and will only be accepted if received as follows: – If the customer has booked prior September 23, 2020, a 10-day cooling-off period will apply and a refund will be provided, less a $200 administration fee. Any requests received after these 10 working days will not be eligible for a refund. Any requests received after September 23, 2020 will not be eligible for a refund. – If the customer has booked on or after September 23, 2020 there will be no cooling-off period or refunds accepted. As we commit expenses for each attendee well in advance of the conference, we must strictly adhere to this policy.

TWIN SHARE OPTION

If you have selected the Twin Share option, you must provide Business Chicks with the name and contact details of the guest you wish to share with. These details must be provided to Business Chicks no later than the 23rd September 2020 (email to info@moversandbreakers.com.au). If for any reason your guest does not successfully book their Twin Share spot at the Business Chicks Movers and Breakers conference, you will be still be charged the full amount of the twin share ticket.

CONFERENCE TERMS

The customer acknowledges that cameras, audio and video recorders may not be permitted at this event. The customer also acknowledges that Business Chicks films and photographs every event and that the customer consents to Business Chicks using their name, likeness, image and/or voice in the event that they are photographed or filmed in any media for an unlimited period without remuneration for the purpose of promoting any service and/or products supplied, and/or distributed, by Business Chicks. Views expressed by speakers are their own. Business Chicks cannot accept liability for advice given, or views expressed, by any speaker at the conference or in any material provided to delegates. Business Chicks reserves the right to make alterations to the conference program, speakers, venue and timings. Details of speakers and topics are correct at the time of going to press. However, circumstances beyond the control of Business Chicks may necessitate substitutions of speakers and topics for which Business Chicks cannot be held responsible. Any changes to the program will be noted on our website www.businesschicks.com.au/moversandbreakers and you should check regularly for updates. If an event is cancelled or postponed by Business Chicks, the customer may credit the ticket price towards another event, or obtain a full refund of the ticket price. No administration fee will be charged. All additional expenses incurred by the delegate outside of the conference program are to be covered by the delegate, e.g. room incidentals, additional food and beverages outside of the provided meals, touring, activities, any additional accommodation required, upgrades, phone calls. In the event of it being found necessary, for whatever reason, that the conference is being postponed or the dates being changed, the organisers shall not be liable for any expenditure, damage or loss incurred by the delegate. In the rare event that the conference is postponed due to events beyond our control (such as natural disaster), a new date for the conference will quickly be secured.

IMITATION OF LIABILITY

Certain laws imply terms, conditions and warranties (prescribed terms) into contracts for the supply of goods and services and prohibit the exclusion, restriction or modification of such term, conditions and warranties. The liability of Business Chicks in respect of a breach of a prescribed term or any warranty made under these terms of sale is limited, to the extent permissible by law and at the option of Business Chicks to:

  • In the case of services, the supply of the services again; or the payment of the cost of having the services supplied again; and
    • In the case of goods, the replacement of goods or the supply of equivalent goods; the repair of goods; the payment of the cost of replacing the goods or acquiring equivalent goods; or the payment of the cost of having the goods repaired.

Unless the terms and warranties are included in these Terms of Sale, all prior discussions, quotations, warranties and Prescribed Terms, to the extent permitted by law, are excluded and Business Chicks will not be liable for any loss or damage or for consequential loss or damage of any kind arising out of the supply or failure to supply of goods or services, or arising out of Business Chicks’ negligence or in any way whatsoever.

MISCELLANEOUS

These Terms of Sale are to be construed in accordance with the laws from time to time in the state of New South Wales, and the parties submit to the non-exclusive jurisdiction of the courts of New South Wales. These Terms of Sale contain all of the terms and conditions of the contract between the parties and may only be varied by agreement in writing between the parties. Any conditions found to be void, unenforceable or illegal may, to that extent, be severed from the agreement. No waiver of any of these Terms of Sale or failure to exercise a right or remedy by Business Chicks will be considered to imply or constitute a further waiver by Business Chicks of the same or any other term, condition, right or remedy.
